Privacy Policy

Marginal Gains, Inc. (“we”, “us”, or “our”) manages the personal information provided by our customers in accordance with this Privacy Policy. This Privacy Policy applies to our websites and to the mobile applications we provide (the “Apps”).

Compliance with Laws

We comply with the laws and regulations applicable to the acquisition, use, and other handling of personal information, including the Act on the Protection of Personal Information of Japan, as well as this Privacy Policy.

Personal Information

“Personal information” means information about an individual that is provided by customers through the use of our products and services and that can identify or specify the individual, such as name, gender, date of birth, age, occupation, postal code, address, email address, telephone number, and fax number. Information that cannot identify an individual, such as statistically processed information, is not regarded as personal information.

Purposes of Collection

We may collect personal information for the following purposes. If we use personal information for purposes other than those set forth below, we will announce or notify you of such purposes individually at the time of collection.

Information Collected in Our Mobile Apps

Our Apps are designed so that the Apps themselves do not collect or transmit personal information. Unless otherwise stated for a specific App, no account registration is required, and information you enter or generate within an App is processed and stored on your device.

Advertising

Some of our Apps display advertisements served by Google AdMob, a third-party advertising service provided by Google LLC. In connection with serving advertisements, the AdMob SDK may automatically collect and transmit to Google certain device information, such as:

For users in regions where consent is required by applicable law (such as the European Economic Area, the United Kingdom, and Switzerland), we obtain consent regarding the delivery of personalized advertisements through a consent form provided by Google’s User Messaging Platform (UMP) when the App is launched. You can change your choice at any time from the settings or menu within the App (where available).

You can also limit or reset the use of advertising identifiers through your device settings (e.g., “Delete advertising ID” on Android, “Allow Apps to Request to Track” on iOS).

Third-Party Networks Accessed Through Our Apps

Some of our Apps assist you in connecting to Wi-Fi networks provided by third parties, including displaying the network’s login (captive portal) page. Any information you enter on such a login page is sent directly to the network provider and is not obtained by us. The handling of such information is governed by the privacy policy of the relevant network provider.

Retention Period

We set retention periods for personal information to the extent necessary for the purposes of use, and we delete or dispose of personal information after the retention period has elapsed or the purpose of use has been achieved.

Disclosure to Third Parties

We will not disclose or provide personal information to third parties without the customer’s consent, except in the following cases:

International Data Transfers

We are located in Japan, and personal information we collect is processed in Japan. Information collected by third-party services such as Google AdMob may be processed on servers located in various countries in accordance with the privacy policies of those services.

Cookies

On our websites, we may use cookies, web beacons, and other similar technologies. In any case, the information collected does not include new personal information, but it may be used in association with personal information you have already provided. You can configure your browser to delete stored cookies or to refuse cookies. However, if you delete stored cookies or disable cookies, some functions may be restricted.

Security Measures

We take necessary and appropriate security measures to prevent the leakage, loss, or damage of personal information, and we strive to improve such measures.

Continuous Improvement

We strive to continuously improve our handling of personal information through the development and review of internal rules, the provision of training, and other means.

Your Rights

If you need to request disclosure, correction, addition, or deletion of the personal information you have provided to us, please contact us yourself through our contact page or the contact details listed on the store page of the relevant App. Depending on the laws of your country or region (such as the EU General Data Protection Regulation), you may also have additional rights, such as the right to restrict processing, the right to data portability, the right to object, and the right to lodge a complaint with a supervisory authority. We will respond to requests in accordance with applicable laws and regulations.

Our Apps themselves do not hold your personal data; therefore, data created within an App can be deleted by deleting the App’s data or uninstalling the App. For the deletion of information collected by third-party advertising services, please refer to the privacy policy of the relevant service and your device settings.

Children’s Privacy

Our Apps are not directed at children under the age at which parental consent is required under the laws of their country or region. We do not knowingly collect personal information from such children. If you believe that a child has provided us with personal information, please contact us, and we will take appropriate steps such as deleting the information.

Changes to This Privacy Policy

We may revise this Privacy Policy as necessary, such as in response to changes in laws and regulations or in our services. If we make material changes, we will announce them on our website or within the relevant App.

Language

This Privacy Policy is prepared in Japanese and English. In the event of any discrepancy between the two versions, the Japanese version shall prevail to the extent permitted by applicable laws and regulations.
